About the Law

New York State Labor Law sections 240/241 – better known as the Scaffold Law – presents a serious threat to the construction and development industries throughout the State. The statute imposes absolute liability for gravity-related injuries that occur on construction work sites on the contractors and property owners – regardless of the circumstances.

WITH SCAFFOLD LAW REFORM

  • Injured workers rights will be preserved to sue irresponsible contractors who fail to provide them with a safe construction worksite
  • Irresponsible contractors will be penalized by being forced to pay high insurance costs making them unable to compete in the marketplace
  • More taxpayer dollars will be available to build new classroom space in New York City
  • More Minority, Women and Small businesses will have opportunities to grow their businesses creating thousands of new jobs in the nation’s most successful program at the NYC School Construction Authority

WITHOUT SCAFFOLD LAW REFORM

  • Worker safety will continue to be placed in jeopardy because irresponsible contractors have no reason to provide them with a safe construction worksite
  • Irresponsible contractors will pay the same insurance premiums as responsible contractors, or not pay insurance at all, leaving injured workers with little or no recourse
